Metalclad is engaged in the development of industrial waste treatment facilities in Mexico. On January 2, 1997, Metalclad filed the first investment case ever under NAFTA. NAFTA provisions allow the parties to appoint one arbitrator each and a third, who serves as president of the Tribunal, by mutual agreement. Metalclad appointed former Attorney General of the United States, Benjamin R. Civiletti as it`s party-appointed arbitrator. Metalclad`s legal counsel is the law firm Bayh and Connaughton, Washington, D.C.(former United States Senator Birch Bayh). The Tribunal will convene it`s first session July 15,1997.
