Just courts create prosperity. A populace that feels that grievances will not be fairly heard in the courts often resorts to extra-judicial dispute resolution and sinks into corruption.

I think courts will lean on the side of creating "too many rights" than "too few" because it is not a good thing for people to feel that the powerful only get their way in court because of their wealth or political influence. Only a tiny group of people could actually ever get the legislature to redress the grievances that they currently bring to the courts--not because they do not have afair complaint, but because the legislatures are just not equipped to deal with tens of thousands of everyday business and personal disputes.

The years of so-called judicial activism have coincided with the greatest prosperity we have ever seen. It is difficult if not impossible to prove that judicial activism causes prosperity. We can prove that unprecedented expansion was not held back by what some would view as judicial activism.
