If I were legal counsel to CEO I would have advised to file 8-k just like they did. If they don't know whether they will meet or not, its dangerous to guess publicly. Fore and EDS this year both preannounced a range of results and then posted below that range. That is very dangerous to do. Legally, they've filed their 8-k and have probably been advised not to say anything until they know what the quarter looks like. I appreciate your frustration. But, I do give them credit for filing the 8-k and putting everyone on notice that this quarter is at risk.
