I understand the points you make. You have offered a coherent and rational position. And it does directly address my question of standing.

I find your take particularly interesting in that it relies on determining the default. Long ago I concluded that that most conflicts are a function of what the disagreeing parties consider to be the default so it's interesting to me that you have framed your argument that way.

It continues to seem to me that positions taken on this topic are a function of preference. I continue to see both sides and to be unpersuaded on the issue of constitutionality, which leaves only the evaluation of outcome as a basis for picking a side.

and doesn't seem particularly concerned with WHOSE speech is being abridged.

My visceral reaction to that, FWIW, is that it seems awfully cavalier.
