On the website, that's true, but they must have a different video format for the Kindle and XBox360. I don't think either of the Amazon Instant Video apps on those devices use Flash.
I'm not sure you're correct about that. They'd have to encode all of the video in a completely different format to support those devices if that were true, which would mean each piece of video In their library would have to be processed twice, and stored in both formats.

But I don't know for certain.

In addition to the video encoding issues Amazon would face in dealing with Apple devices, there are also business issues. That may be where the real hangup is.
