As a practical matter, yes they can't (do anything).

The club for most of these private suits was the consumer protection statute in each state. All of these statutes are different, but the common thread is that if there is fraud, multiple damages plus attorneys' fees are collectible. The effect of the ag settlements, in most states, will make recovery under these statutes either unlikely or legally impossible.

That means that the only recovery for those who press on is actual damages (without multiple recovery) and no attorneys' fees.

Do you think that attorneys (who will have to try these things one state at a time, because there is no breach of federal law) will press hard when they will only have a shot at single damages? Not hardly.

Bears, this was brilliant brinksmanship. You blinked.
