You can't rely on government to help when a clown starts shooting people. An armed citizenry is what would prevent such things. The guy didn't want to die. He just was seeing if he could play out a scenario, violently breaking many laws and survive the sequence. Much like his role playing games on the computer/x-box/PS3.

His life needs to be snuffed out now, like a candle that stinks.
