You can and certainly should jail for fraud. If mortgage brokers, real estate agents, buyers, sellers, developers, bankers, etc. knew they were taking on loans that they knew were never intended to be paid back because, you know, they couldn't then they are guilty of fraud.

If you believe that Madoff had help in his 20 year scheme then you can't possibly think that the mortgage and loan and debt mess is mostly innocents making bad decisions. It is FRAUD on a massive scale that makes the mess in Iraq look cheap by comparison.
