I don't know if Ruiz cackles or not, but it is clear that AMD has preserved the right to sue Intel by creating a paper chain in its SEC filings under "Risk" were it has always categorised the types of hostile activities it alleges that Intel undertakes against AMD. I remember reading a post a year or so ago that suggested that Intel was in a position to sue AMD for the defamatory nature of those filings. Also, Ruiz has been quite outspoken at CC's and other presentations in acknowledging that AMD must always be wary of the 800 lb gorilla's dominance.
