Curious, why was direct mail left out of the AG's settlement consent decree?

I believe it was just overlooked by the AG's. Their field of expertise is law, not marketing, telecomm, or accounting. I don't think the folks represented by the AG's were really well-served here because AOL was the only expert in the room, to the best of my knowledge.

However, I've seen this mentioned before, and have to agree: AOL is complying with the "letter" of the agreement, but not the "spirit".

I expect them to be taken to task yet again.

Haven't posted here for a while, so let me say I still think the general public has only seen the tip of the iceberg. It won't take too much longer. My April puts may be too short on time, but I'm not too awfully concerned. I keep eyeing the Apr35's right now, as well as longer-term. I still anticipate that someone is going to very publicly ask Steve Case why they thought a 31:1 user/modem ratio was appropriate when the industry standard is 10:1. He'll reply that CIS's ratio is just as bad and say they were the only basis out there for real comparison. What'll be telling is if anyone picks up on the fact that CIS deals with business users for the most part, who aren't competing with the "home from school/work" crowd during their particular prime-time.
