Hello tonysee200x,

I really can't tell you what will occur ... I don't know. I do know that the judge ruled that the Novell lawsuit must be dealt with first. I believe that IBM successfully argued that the Novell suit would then determine whether IBM could be pursued.

Again ... this is now just a legal game ... right? It has been for a long time. For several years it has been high-paid lawyers playing all angles to see if there is a way to capitalize on the situation.

It appears that in the midst of all of the filings, they might have been looking for all sorts of avenues to pursue. When I read through the judges ruling, I was looking for the various claims and which way the judge ruled. Anything in SCO's favor must have been something that SCO wants to pursue.

It seems to me that a non-compete against Novell could be pretty harmful to Novell ... if it's really there.

Still sitting on my lottery tickets ... :-)
