Despite the March 2007 Order, in or about January 2013, the defendant contacted Robert Weidenbaum, an FBI confidential informant, to try persuade him to invest in a penny stock company called Sunset Brands, symbol SSBN, for whom the defendant was working, informally, as a stock promoter. Weidenbaum and the defendant had known each other for years; Weidenbaum had been a stock promoter for UXP prior to the defendant’s trouble with the SEC. Altomare had hired Weidenbaum to engage in various “pump and dump” schemes in 2004 and 2005.

Unbeknownst to the defendant, Weidenbaum had since had his own troubles with the law, and had become an FBI informant. After being convicted of securities fraud in Washington DC, Weidenbaum agreed to work with the FBI to target securities fraud in South Florida. Weidenbaum was given equipment to record calls with anyone who appeared interested in committing securities fraud.
