But in the case of TAVA, the defense would probably be coupled with a countersuit, possibly of the class-action variety.

Do you know how much hell one of the top securities class-action lawyers can raise for a company once they are convinced that there is good chance of finding something.

(I presume there would be grounds for such a class action suit. If the company was doing well, they wouldn't waste a second talking about suing anybody for bad mouthing them. If good companies sued everybody who said possibly libelous things about them, then Bill Gates would be suing 100% of his customers, partners and competitors, as well as the US Senate, Justice Department, most newspapers, etc.

Why no talk about Microsoft lawsuits against their detractors. Maybe because BillG would rather just go out and prove them wrong in the real world...
