You are correct. However, people don't always die (or retire) when people assume they will.
The problem that we have with the Supreme Court is that the other party has control of the Senate. While a future president might appoint another Alito or Thomas, I suspect that Harry Reid has no intention of allowing another Alito or Thomas to even be voted on.

I wish it weren't so, I wish the Republicans controlled the Senate,....but the reality is we don't and probably will not after the 2008 election due to the number of Republican seats that need to be defended vs. the number of Democratic seats that need to be defended (only 1/3 of the total are up for re-election).
