Reference is made to my post to you of December 10, 1998, to which you failed to respond. Please be advised that, on behalf of Michael Zwebner, we have issued a subpoena on Silicon Investor (“SI”) commanding SI to disclose your true identities. Pursuant to Rule 4 of the Federal Rules of Civil Procedure, as a result of your failure to waive service of a judicial summons upon you, the court will impose upon you all costs incurred by Mr. Zwebner to effect service of the summons. The expense of subpoenaing Silicon Investor will be included among the costs you will be required to pay. You may avoid liability for further costs by returning the waiver of service form to my attention forthwith. Otherwise, formal judicial notice will be served upon you personally, and you shall bear the full cost of effecting same.
