Lie? Well that would have to involve knowingly discieving someone and that would be a far more grievous charge than Section 17(b) (failure to disclose).

Steal... Well, I would gladly pay 3 times the fine if that meant that my wife and I were returned just HALF of what we invested in the company.

Cheat... I don't believe that applies in my case. All stock was purchased on the open market and the only security in question was a limited partnership that has paid no returns due to the financial constaints created by this lawsuit.

Btw, David was accusing me of being a short just a couple of weeks ago. Doesn't that mean I'm a kindred spirit.

Btw, I also worked as an FO in an ACR (11C, 19D).

Also, a fine of any kind sucks, but is preferable to paying $300 an hour to some lawyer and racking up an estimated $50,000 in legal defending myself.

Because I chose to make that financial decision, does that make me guilty (or innocent)? (btw, I'm not guilty or innocent in that settlement. I've just agreed not to ever make the same mistake
again.) Making a mistake is not a crime.

I take it you've never paid a fine in your life because it would have cost you more to defend yourself?

And were I a paid "shill" for TAVA, don't you think I would be pretty stupid to be out here discussing the company without disclosing anything except that my wife and I are long the stock?

If you don't agree, report me to the appropriate authorities.

Now why don't you go away, grab your gallon of Break-Free, and swab a gunbore, while the rest of us figure out who is willing to make the bigger bets on TAVA's shares over the next month or two.

After all, the real game is about money and who is willing to take the greater risks with their capital, the longs or the shorts.

Finally, I don't spout about Bill Wexler's perspective. He can claim the stock is overvalued if he wants, and invest as his spirit carries him. What I take issue with is his deliberate avoidance from discussing fundamental analysis. I take issue with his slanderous methods and not that he is short.

You have only to see how he desperately seeks to malign anyone who says anything positive about this company in order to discern his INABILITY to discuss fundamentals or earnings.
