RMR - I do not have all the facts before me. I do not know if the NY Times reporter had all the facts. All I know is that in a default, there is no trial, no judge, no jury, just a clerk that enters default because the defendant has not answered the complaint, or fails to show up at trial. If you have more facts about this trial, I'd be glad to hear them, and please provide your source. thanks
