If you only make a few trades a week, you probably will not qualify for trader's status. And there exposes the weak link of the SEC's definition of a pattern day trader and that of the IRS. I believe any half decent lawyer could exploit this damned if you do and damned if you don't situation in court and demand the government agencies definition be of uniformity. Dominick
