Big Surprise .... NOT XM Satellite said suit against it is dismissed Thu Mar 29, 2007 3:17pm ET NEW YORK, March 29 (Reuters) - XM Satellite Radio Holding Inc. said on Thursday in a federal filing that a class-action lawsuit against the company has been dismissed. The document, filed with the U.S. Securities and Exchange Commission, did not name the plaintiffs, or the location of the court. An XM spokesman was not immediately available to comment. The filing said that on March 28, XM's motion to dismiss the securities class action litigation was granted and the case was dismissed. It said "the court concluded that "plaintiffs have failed to identify any materially misleading statements or omissions that are actionable" under law.
