In response to your question, nothing happened to "separate but equal" branches of government.

In fact, during times when SCOTUS has been more liberal than the President and/or Congress, the Left has always championed SCOTUS and the judiciary as the bastion of democracy.

It's only in recent times that they're intolerant, poor sports -- no, worse than that -- when they don't get their way.

Shame on Bill Maher for entertaining the thought(lessness).
