Afaq: The HVSF claim has no effect on Vivus or its products.HVSF has asked the court to allow them to manufacture their product claliming they are not infringing on any intellectual property belonging to Vivus. Vivus disagrees with this position and will attempt to enforce their patents which HVSF needs to proceed with their product.
These patent challenges are common and Vivus is extremely sophisticated on patent issues. HVSF will need to spend alot of time and money if it is to prevail. Vivus is much better positioned for this challenge than HVSF in my opinion.
