Unfortunately, I can not point you to a piece of code that specifically addresses shorting bulletin boards. There is much code about short requirements, upbids, borrowing, availability, affirm determination, yet I have not seen particular code on short stocks. I wont be so bold as to give NASD"s interpretation, but Pershing (one of the largest clearing firm )and their legal department specifically ok's it as long as it meets other nasd rules, suitability, and see above.
