Icahn's Legal War

“Each case that Q filed against Carl Icahn has either settled or survived a motion to dismiss when challenged by Icahn, and the unsettled cases are actively progressing forward,” a Q spokesman said in an email about the XO lawsuits. “Additionally, Arthur Abbey, a well-known attorney representing an unrelated shareholder, has also filed similar lawsuits against Icahn for his actions in XO.”

The Hillenmeyer's class action against Carl Icahn represented by Arthur Abbey is potentially more significant but less exposed by the media than R2's case, which is often treated unfairly only as a case of hedge fund against another hedge fund by media.

Minority share holders own a total of 85 million shares of XO common stock. R2 owns only about 15 million while Hllenmeyer class action represents thousands mostly regular individual share holders.
