You're right, I was using inaccurate language when I said "tried cases".

I can see the argument you're making. And frankly, I'm sure there will be no stopping Kagan's nomination.

I'm not sure I like the situation where the left gets to shoot down conservative nominees and we foreswear blocking leftist ones. I don't think a Democratic Congress would have let Alito and Roberts, who I believe were both nominated in 2005, on the court.

This is a moot point at present.
