It is true many social conservatives (and others) are avoiding the public school system for private schools (including home schools), and with a little leadership this trend hopefully will gain speed in the next decade. But I think other such institutions can be built along similar models, particularly for religious social conservatives. These folk now generally overlook the vast resource that is the Church. They also overlook the potential legal advantages and opportunities available to them as a result of the Church's unique relationship with the state. This could change such that resources are in concert directed from wasteful activities (such as supporting the GOP) toward a redoubling of the effort of building first-rate church-based institutions.

The "patient's bill of rights" was developed to protect consumers within a system that produces services that are fundamentally very good. I do not think such legislation can remove the fundamental flaws of the current public education structure.
