When Nokia issued their recent press release, they stated, "The payment announced today does not extend, and is not related to, the old agreement." That suggests Nokia considered their payment could be construed otherwise. Qualcomm obviously believe that a factual dispute leading to the opposite legal conclusion exists, and have demanded arbitration to resolve that issue. One party is right, one wrong.
