Keith: If the Supreme Court upholds the FCC position, the FCC will "put" the spectrum to the carriers that have already bid for the spectrum and collect all the money. If the FCC upholds the NexWave position, they will "put" the spectrum to the carriers and collect all the money or split it with the FCC (with new Congressional approval).

Well, your almost right.. Except the point you need to remember is that Nextwave can not "put" the spectrum to the carriers and collect all the money. The 5 year buildout requirements on all of their C Block licenses have expired. How much is spectrum worth whose buildout deadlines have expired? ZERO!

As I have stated since last July. The only viable "carriers carrier" business for Nextwave would be to provide services to those that need the spectrum the most.. And that would be the GSM carriers.

Most of those that promised funding for Nextwave now realize that they were simply being used as "pawns" by Nextwave in their negotiations with the FCC. Even Qualcomm has grown tired of their deceit.

Their "Know the Truth" logo is long gone.. Along with their web site!

Their is no strategic importance on Nextwave.. Never has been.. Just a group of "borderline criminals" that were not even eligible to bid on the spectrum in the first place.. They lied on their applications to participate in the Auciton, and continued in their trail of lies and deceit over the last 5 years. Along the way, some that should know better have been induced by their "scam".

Oh! Look at poor ole' Nextwave. Bad nasty Kenard wants to take away from them what they didn't pay for, and violated Federal Law to claim title too in the first place.

Like I have stated several times... They waived the CDMA pendulum in front of everyone's eyes. And the Kool-Aid line formed real quick. It takes a while for the "Kool-Aid" effect to wear off on some.. Maurice seems to exhibit some strange biological functionality which prohibits the dilution of the Kool-Aid effect, until long after the facts become apparent to everyone else! (I am not trying to be mean Maurice! Just honest!)
