Amir, according to my broker the only pieces of news accounting for the drop (which was also experienced to a lesser degree by BEAM) is that a lawsuit was initiated by an eye doctor on antitrust grounds for the cost per eye to the medical practioners. The contentious figure quoted to me over the phone was $250 per eye which doesn't seem to me to be a lot to be rid of glasses and be able to see.

The company states that the suit is without merit and I sure agree. If no one else developed the technology and you have glasses to wear no one is forcing you to pay the price.

I also heard that a negative article about the marketing techniques of the company was printed in the WSJ. My broker attending a symposium in L.V. last month was next door to the conference taking place by VISX. He grabbed some of the literature available and noted that in his opinion there was a heavy tone of patient hype, push and psychology in the material aimed at instructing the would-be practioners. This is all I heard and all was word of mouth from the broker.

I think they'll recover but may have to act more like the AMA and less like a Madison Ave marketing firm. The lawsuit IMHO is frivilous.

Good Luck, TOMSTER
