Depends on circumstances. If they are sipping coffee after a meal in a public restaurant, the bill has been paid, she is clearly free to leave, he leans over and says "oh, come on, you don't really mean that, do you?" that is persistence, but not rape. At least, in my view; X and other initial posters may disagree.

If they are in his apartment and he is persisting in trying to kiss and fondle her, then it is rape. Or more accurately at that point assault, but perhaps leading to rape.

That's the problem with discussing generalities. Circumstances are key.
