But it is also a strategic defense of Darwinian theory. I haven't read it, so I'm not sure whether it is or not. If it is I would consider that more of a weakness than a strength. I don't see it as a judges role to defend a scientific theory. The issue is simple was the school district establishing religion or was it not. Either way I don't really see the defense of any particular scientific theory as relevant. Tim
