If I understand your point correctly, you're saying that regardless of the disclosure, or lack thereof, the result would have been the same? The yield problems were not the limiter, the general market was. If that's your point, all I can say is that I'm not a lawyer so I'll leave it to one of them to argue, and I suspect they'll be lining up.
