Maybe you can find some other source of law that applies to the situation vis-a-vis the detainees at Camp X-Ray, but the Geneva Conventions are not that source of law. The Geneva Conventions are treaties between nations, aka High Contracting Parties. Afghanistan is a nation. The US is a nation. The detainees are not signatories to any of the Conventions, and have no status other than that which is afforded them as citizens of a High Contracting Party. If the nation of Afganistan says they aren't Afghani citizens, who on earth is going to force Afghanistan to say otherwise? Rights don't exist in the air, they exist in context.
