I for one (while not a lawyer) think they'll have a very hard time proving this. It was management's conscious decision making process to not include those extra digits.

Y2Kok applications have been built with Y2Kbogus parts (instead of using the system date, just input a 4 digit control card & make sure ALL the programs use a single common date routine... duh!!!)

Bottom line is... if I sell you a hammer, there's not much I can do to prevent you from smashing your thumb with it.
