Let me suggest you update your staff’s knowledge of the rules regarding service of papers. Service of papers for virtually all motions save and except Motions for Summary Judgment are required to be served by fax or overnight delivery or other means to ensure they are likely to be received the next business day. In lieu of that, they can be personally served, of course, or you can add 5 days and serve them by mail. See Section 1005 of the California Civil Code of Civil Procedure. I look forward to seeing your reply therefore by overnight delivery or fax.

Finally, it is regrettable that you have relied on information from the Plaintiffs’ attorneys, the Orrick firm. As is evident from your moving papers, you are quite ill-informed regarding the underlying facts."
