That is an interesting perspective. To my knowledge, historically those who fight an opposing army on the field of battle have not generally been regarded as "terrorists." It would seem that the definition of "terrorist" has been expanded to "anybody who attempts to repel the advance of our armies."

You still end up with the question of "who gets to determine who was caught fighting us on the field of battle, and who was not caught fighting us on the field of battle?"

Should each individual soldier be authorized to make that decision, and thus keep a person in perpetual imprisonment? Should it require the determination by an officer? Or, to get really wild and crazy, should there be a judicial determination????
