Or they're having difficulty producing the Si-28, and are trying to hide that fact by disputing the terms of the contract. Remember that their ISON shares are in jeopardy if they fail to deliver the Si-28 as planned. If they get the production completed by the time the dispute is settled (i.e. if they can drag the dispute out long enough) they can turn over the promised amount of Si-28 "now that the rest of the details are settled".
