John,

That's been Bill Foley's intention all along. He's gradually buying up shares of CHKR and RLLY. His intention to merge CKE with Hardee's actually happened back in 1997 sometime.

Bill Foley is probably elated that the stock prices of CHKR and RLLY are so cheap, since the cost to him of buying up those companies is now a lot lower. The low investor morale towards those companies after the "failed mergers" between CHKR and RLLY is certainly working in favor of that! Also, the fact that neither company has really turned much of a profit yet helps too (I almost wonder if Foley's really intending on during that much to bring in a profit until he completes the mergers, which are supposed to happen sometime in the next few years...I haven't spoken with my source for a while, but early last year he said "in several years"). I can see the amount saved in purchasing CHKR/RLLY being much greater with no or little profit from either company than the actual amount of profit realized if more effort were put into making a profit now. Obviously, Foley has made some effort though in turning them around, partly to keep the debt down and partly to avoid conflict with managers/investors/etc.

I really don't know where these stocks will go from here, though this might be a good time to gradually accumulate, especially since the 1998 tax sell-offs are over with. Right now, I own none of these stocks, partly because I've been using my money for other things lately (like I recently bought a house, which is no small feat in southern California!).
