DPAC says court rules it did not infringe patent
GARDEN GROVE, Calif., March 8 (Reuters) - Memory device manufacturer DPAC Technologies Corp. (NasdaqNM:DPAC - news) said on Friday a federal appellate court has upheld a ruling that it did not infringe on a patent held by SimpleTech Inc. (NasdaqNM:STEC - news).

DPAC said the ruling followed a hearing in federal court on Wednesday.

The company said the appellate court's ruling affirms a March 2001 lower court ruling that it did not infringe on SimpleTech's patent.

Garden Grove, California-based DPAC did not elaborate on what is covered by the patent in question.

DPAC shares were up 38 cents, or 11.6 percent, at $3.65 in afternoon trade on Nasdaq, where SimpleTech shares were up 41 cents, or 5.7 percent, at $7.60.
