If I was Shinn I'd give Shapiro all the HTDS shares Shinn owns for the Tubercin test data.
Will Shapiro take those next to worthless shares?
Probably not.
I think Shapiro has been paid already anyway, surely, for his services. I suppose he feels duty bound to deliver the results to those who hired him - which was not ATKJ but HTDS or an affiliate thereof. So he, Shapiro, has test results that are valuable to ATKJ but next to useless to HTDS.
And HTDS is fighting tooth and nail for this useless test data. Cause I doubt ATKJ will ever speak to them again or give them the time of day, for that matter, so any deal between HTDS and ATKJ concerning the test data is as remote as can be.
If this can't be amicably settled to ATKJ's satisfaction, I'd guess that the only recourse is to sue Shapiro and the testing authority, for infringement of the Chung Tubercin US patent and perhaps HTDS as well for contributory infringement .
What does HTDS get out of all this?
Revenge - oh boy, what sweet revenge!
Money?
Not a dime!
Like little kids in the school grounds.
Solution?
Grow up!
Maybe HTDS/Shapiro would exchange the test data for a healthy, non-controlling, block of shares in ATKJ? Then ATKJ can assess the test tresults, use them to advance Tubercin towards market, the ATKJ price rises as Tubercin is appreciated in the medical community, ATKJ shareholders are happy as is HTDS who has a healthy block of shares.
Dreaming?
Probably. |
