It was the choice of the word empathy as one of the major qualifications that made me uncomfortable in that it could imply a certain abandoning of impartiality. THis is what the opposition is now looking for-- weaknesses in the opinions because of that loss of impartiality. I agree completely that empathy is essential for keeping one open, but I would hate law to be based on a preference because of empathy, rather than good judicial reasoning.

So if her rulings have been well-supported, and I leave that to the experts here, then empathy is certainly a plus.
But I also think that empathy isn't restricted to any one party. Just because Roberts is conservative in his approach doesn't mean he has no empathy, he may just be very careful in allowing it to sway his legal analysis. Dunno.
