The point was how easy it is to work around design patents. And as such, they are quite worthless.

You won't get an argument from me that Android didn't clone much of the iPhone (iPhone has returned the favor). I know that WP7 has a much different UI... original, newer and better.

But Google and Samsung can make small changes to bypass those design patents. In case you have not noticed, despite Apple's Australia success against one single product, Android is dominating in market share. Any successes Apple has in court will be quite meaningless and short lived.
