It's a violation of the Geneva Conventions to publish photos of prisoners of war. On the other hand, Saddam is no longer in our custody, he's in the custody of the Iraqis, so he's no longer a prisoner of war, so the timing matters.

It is, however, a violation of his right to privacy and he's got the right to sue for invasion of privacy. I don't know enough about English law, but he seems to have a good case. I am not going to do any research, as the concept of Saddam in his skivvies is horrifying to me and looking at them would make me wish I were blind.
