Interesting that Scalia and Thomas couldn't even get Alito and Roberts to go along with a legal justification for executing someone who could very plausibly be innocent. I guess they will become crustier and crustier, the aging bastion of reactionaries in a Court and a world that will keep passing them by. It will be a real pleasure if Obama ever gets to replace one or both of them.
