Geneva Convention works for events about a generation ago. In those days, you had a nation fighting a nation. These days that is not the case.

IMHO, Throw the Geneva Convention out.

They can still be used, since they weren't written as a suicide pact. Thus the requirements in the Fourth Geneva convention to qualify as a legal combatant: wear a uniform, be part of a military hierarchy, etc.

What the NGOs are trying to do is change the meaning of the conventions so they can be used against the US. For instance, I have seen some ruling propagated by the Int. Red Cross to the effect that everybody must be classed as a POW or a civilian, no exceptions. It seems to be a current lefty meme that this interpretation should be accepted as "international law". Of course, this has nothing to do with the actual text of the conventions, which specify that saboteurs (their example of unlawful combatants) may be shot out of hand. Not to mention the fact that Al Qaeda is not a signatory and that reciprocity is not to be expected.
