Personally, I feel much more strongly about the chances of them being ending up much lower in 4 weeks than I feel about them staying where they're at.

I think it's a below-the-belt hit and won't hold up in court, but I do expect it to help nudge AOL lower. There are plenty of other factors, though, that'll keep sending it down.

On the subject of the above article, the reason I don't expect it to hold up in court is that similar suits have been filed against BBS operators many times over the years. The decisions have gone both ways, but the overwhelming majority of them have come out as "the carrier can't be held responsible for the content".
