MCAF was mentioned favorably in the recent Fortune Magazine's list of the 100 fastest growing companies. Also consider that weaker companies usually sue those who are stronger. They figure that if they can't win in the marketplace they will try to win in court but this stategy usually fails. Apple sued Microsoft and lost. AMD sued Intel and won something in the courtroom but lost in the marketplace. DEC sued Intel and Intel has mounted a countersuit. Can anyone think of a counterexample? I'd like to hear about it.

Chances are that some illegal code did get into MCAF's products due to some action on the part of an unethical employee. This is not uncommon. But this does not implicate MCAF in wrongdoing unless they knowingly encouraged such illegal activity.

Product liability is a different matter. If MCAF was being sued on that basis I would stay away. Consider the recent flack over the weight loss drugs which are suspected of causing heart valve problems. Even if the allegations are proved false these drugs are probably doomed. But customers continue to love MCAF's products.

My main worry is competition especially from MSFT which has a history of entering growing markets after the ground work has already been done by upstarts. The only defense is proprietary technology. Do you know MCAF's position in this regard? If they do have proprietary technology then MSFT might enter this market by purchasing MCAF which would be very bullish. Otherwise, MSFT would just take over the market as they did from Apple via Windows which would be very bearish.

I don't own MCAF but looking to buy at some point.
