if there's no evidence, what's wrong with letting them go? Isn't that what we're supposed to do if there's no evidence?

If we're going to require evidence, why bother to capture them in the first place? If we're going to send them back, why not just leave them there? When we get into a firefight, when it's over and they are dead or disarmed, we can just walk away. In that scenario, though, do you think it would be too much if we captured their weapons so they couldn't shoot us while we're walking away but would have to go back to their bases first and get fresh ones?

Pardon the edge in that but I'm really having trouble figuring out where you are coming from. What I'm picking up here on the receiving end is not making any sense to me.
