Pardon the edge in that but I'm really having trouble figuring out where you are coming from.

Where I am coming from is that it is a violation of due process to detain people indefinitely without evidence of wrongdoing.

Walking around in Afghanistan carrying a gun is as common as dirt, and by itself means nothing. Every man and boy in Afghanistan is armed.

If we're going to require evidence, why bother to capture them in the first place?
