I was looking back today at Mr. Justice Macfarlane's remarks from his ruling of Feb. 27, 1998, as found in reply #1124 on this thread.

How Thermo can think that the 1992 technical manual with its dates changed and one page added can fulfill Mr. Justice Cohen's order, is beyond me. The court has ALREADY decided that that technical manual is an inadequate fulfillment of the licensing agreement.

Macfarlane writes in [8], "It is submitted that a proper interpretation of paragraphs 2 and 3.02 of the agreement is that what is to be delivered is a technical manual, which was delivered in 1992 . . . "

After dismissing that submission, Macfarlane concludes in [12], "The defendants are in contempt of the order ..."
