Thanks for the informative response. As you can tell I am not a lawyer and was unaware things were so complicated. Even if this never goes to trial, ANCR will still have spend some time and money getting it dismissed.

However, I do think they have a case. In the beginning of the year management had a very bullish outlook and mentioned that this year was going to be a scorcher. I and others bought this stock on that statement alone. We figured they knew something we didn't. And this was all before the Sequent debacle. Smells really fishy to me.

Regardless of the outcome of the suit we all lose. Investors get very little if anything of the distribution and it puts an unnecessary hardship on the company. Only the lawyers win. But hey, someone should pay!
